Rental conditions
1- DOWN PAYMENT

To confirm a booking/option, 25 % of the price of the rental period/contract has to be paid at the latest 4 days after the invoice date. The prepayment binds Riviera Holiday Homes as well as the customer to the order. If Riviera Holiday Homes does not receive the prepayment within 4 days, the booking/option will be cancelled.

2- CONTRACT

When payment is received, the contract confirms the booking.

3- FINAL PAYMENT

contract is agreed less than 1 month prior to the arrival date the full rental amount has to paid at once, in order to confirm the booking. When full payment has been received, Riviera Holiday Homes will send an arrival-voucher to the client with agreement details, all practical issues such as address, telephone, when and where to pick up and to return the keys to the rental apartment/villa.

4-PRICE

The price announced on the website RivieraHolidayHomes.com comprises the administration fee and the final cleaning. In France tourist have to pay a holiday tax to the local authorities in Euros. This fee as well as other extra services such as rental bed linen, towels, baby cot, airport key pick up, charges for telephone and electricity etc. are charges that come in addition to the announced price on the Internet site.

5- DESCRIPTION

The descriptions of the rental property is based partly on Riviera Holiday Home’s own inspection of the accommodation and the local facilities, and partly on information gathered from the owners of the accommodation. Whilst all such information is given in good faith, Riviera Holiday Homes cannot be held responsible for printing errors or inaccuracies concerning distances to certain facilities (beaches, town centre, restaurants, shops, fishing possibilities, sports facilities etc.) nor for the existence of such facilities after the client’s reservation has been made. Riviera Holiday Homes also declines responsibility for possible closure of facilities such as shops, swimming pools, beaches, stretches of road and like conditions beyond Riviera Holiday Home’s control, including e.g. increases in local tourist taxes etc. “Pets are allowed” means that only 1 cat or 1 dog can be accepted in the rental accommodation. The client must inform Riviera Holiday Homes if he or she wishes to bring a pet into the accommodation. All the rental accommodations dispose of crockery, blankets and pillows. Bed linen, towels and baby cots are not provided unless the contrary is announced in the description of the accommodation. The maximum authorized number of persons for each accommodation is announced in the description. If the number of persons in the tenant-party exceeds the maximum authorized number of persons, Riviera Holiday Homes has the right to deny the client entrance to the accommodation; and in such cases the client has no claim to a refund of the rental amount. The maximum authorized number of persons comprises children and babies over 2 years.

6- DAMAGE DEPOSIT

The renting party is obliged to treat the rental accommodation and all belongings in a careful and proper manner because he/she and his/her accompanies are responsible for any damage that is caused. A security deposit must be paid by the tenant to Riviera Holiday Homes’ representative upon arrival. The amount for the damage deposit is mentioned on the booking. The damage deposit can be paid via a signed credit card print, a French check (only). This amount will be held by Riviera Holiday Homes and shall be returned to the client after deductions to cover any damage caused to the accommodation and any applicable extra charges (telephone consumption etc.). The paid deposit will be refunded within 48 hours after the rental period if the rental object is returned in good and clean condition with all belongings. In case the amount of the damages exceeds the amount of the damage deposit, the client binds him-/herself to pay the exceeding amount to Riviera Holiday Homes.

7- INSURANCE

The agency RIVIERA HOLIDAY HOMES has subscribed to LOCPLUS, an insurance contract taken out by PM CONSEIL ASSURANCES with the company ASSURANCES ACE European Group Ltd. The tenant will have, for all stays up to 3 months’ long, a cancellation insurance as well as civil liability insurance in regard to the owner of the rental property, according to the clauses stated in, to this contract, appended document. N.B. any cancellation has to be signified to the agency by certified mail with acknowledgement of receipt.

8- COMPLAINTS

In case of a complaint concerning the rental object during the renting period, the renting party has to inform Riviera Holiday Homes or its local representative in the form of office/agent, immediately and within 72 hours after the point of take over about the discrepancy. If the renting party is not satisfied with the solution that is offered, the renting party shall contact Riviera Holiday Homes preferably by phone. + 33 4 93 16 03 44 (or by fax/mail: + 33 4 93 6 03 90 / contact@rivieraholidayhomes.com), to enable Riviera Holiday Homes to try and resolve the complaint to your satisfaction. Failure towards this procedure will hinder Riviera Holiday Homes’ ability to resolve the complaint and/or investigate it in fully and any right to compensation will be substantially reduced. In case the renting party leaves the rental object whiteout having informed Riviera Holiday Homes and without having given Riviera Holiday Homes a chance to correct, the renting party withdraws itself from all possible refund. In case the cleanliness of the rental object is not satisfactory, this should be reported to the owner or representative in the form of office/agent, the day of arrival. Riviera Holiday Homes will in all cases try to meet the expectations and wishes of the customers.

9- APPLICABLE LAW

The present contract shall be governed by and interpreted according to French law. Any disputes arising from the present contract shall be referred to the French courts.
